SKDF has now suggested that I may take up the PIL which shall be fourth CBI enquiry / PIL. First was ordered by Bihar government on December 06, 2006, Second was PIL in early January and third by SKDF through Parivartan in which mischievously it asked Supreme Court to direct CBI to look into Satyendra Dubey Projects at Barachati only alleging Rs.600 crores fraud in this section. Loot as per SKD charge sheet is Rs.25,000 crores and more.

Politicians in India specialize in using all kinds of damage control methods whenever some scandal erupts. When nephew of Atal Bihari Vajpayee was thrown out of running over crowed train near Delhi police caught some innocent to show efficiency. Kalyan Panda, Ashutosh Mishra and Atal Bansal were firefighters and damage control agents of SKDF.

 

Within minutes of Promod Mahajans death, a lawyer emerged claiming that Praveen Mahajan was mentally unsound. With little more demand from public to show SKDF accounts, Kalyan Panda too may take to this time tested excuse.

 

SKDF was clandestine damage control operation of NDA to firstly delay filing Real PIL to investigate Satyendra Kumar Dubey chargesheet by 100 days that too due to insistence of several Whistle Blowing within SKDF, PIL filed actually desired investigation in to Barachati section managed by Satyendra Kumar Dubey only. It common in cases of major Rail Accidents to blame Naxals by Minister in Delhi even before any senior and responsible railway official could reach the site when actually rail track is rotting.

 

We have asked Kalyan Panda and Ashutosh Mishra to hand over SKDF to Styandra Kumar Dubey family for two months in who are the rightful owners of Satyendra Kumar Dubey legacy.

 

We always wanted to “Re-institute The Case” with focus on letter of Nov11, 2002.

 

At the moment we don’t have any information, all the files and submissions of the parties are with Kalyan Panda or his attorneys.

 

THIS IS YET ANOTHER OF DAMAGE CONTROL EXERCISES TO MISLEAD PUBLIC.

 

My second strategy to publicize Satyendra Dubey Letter of Nov.11, 2006 through e.mails too was turned down by SKDF in December, 2003. SKDF knew of this letter posted on Indian Express website but didn’t inform groups or me about it. That’s how I am sure of my understanding of the “Operation Save Shining Campaign”.

 

We know our job but Kalyan Panda and Ashutosh Mishra are more faithful to their political masters than Satyendra Kumar Dubey.

SKDF has only shed crocodile tears and made false promises until now.

You are also member of the public. Hence you have all the right to file a PIL (Public Interest Litigation) at any moment of time. Justice may be had any time. If you feel that you could/can have done in a better manner, you may always go seperately anytime now even. Whatever assistance/help you want may be extend. I don't mind losing on that count as it would help the nation. Losing also would be a win for me. I was never in the process in the PIL as I was a simple member then. But that does not relegate/relinquish my duty.

Your success in this respect would be welcomed warm heartedly.

With all the information from martyr SKD written in detail in his letter to PMO and NHAI (copy of the letter is here in this email),  SKDF could not bring out proper PIL and go after CORRUPTION and LOOT that was happening in NHAI.

Read this PIL on Quota, which was heard immediately. How fast they did it.

NEW DELHI, MAY 28:The row over 27 per cent OBC reservation in premier educational institutions is all set to take a legal turn with a PIL being filed in the Supreme Court, seeking to quash the proposed quota law and the Constitutional amendment. The court’s vacation bench will hear the PIL tomorrow.
The writ petition has been filed by Ashoka Kumar Thakur, Supreme Court senior counsel who also argued in the Mandal case for fixing economic criteria, resulting in the creamy layer. It’s listed for hearing tomorrow before the vacation bench of Justices Arijit Pasayat and Lokeshwar Singh Panta.
In his petition, Thakur said: “Affirmative action by the Government to remove discrimination, inequality and disparity is quite an important step in a healthy democracy. But recent developments in this context, which infringe fundamental and legal rights of the larger section of citizens, create social upheaval, anarchy, chaos and unrest leading to an adverse law and order situation, when the issue of reservation is already settled by Supreme Court, requires to be judicially reviewed in the interest of equity, justice and fair play.” 
“The last caste census was done in 1931” and “all census since 1951 have break-up of population based on religion only” not caste. Referring to the Constitution which provided reservation for only SC/STs and that too for a period of 10 years commencing 1951, the petitioner contended that the SC/ST reservation of 15 and 7.5 per cent respectively “has been extended indefinitely” and now, another “new section” of the citizenry, OBC, not sanctioned by the Constitution, has been added “with a political view”.
Thakur, in his petition, has quoted Jawaharlal Nehru, saying he had opposed continuation of reservation “as a principle” in 1961. The petition refers to the Kaka Kalekar Committee which in the 1950s had “enumerated approximately 1,200 OBC castes” and the Mandal Commission which listed some 2,200 castes as OBCs “based on social and economic criteria”.
According to the petition, the OBC list has been increased further with some 3,200 castes being included. 
“Mandal Commission had fixed OBC population in India at 52% based on fictitious data. In case we add SC/ST (24.4%), Muslims (13%), Christians (2.4%) and Sikh, upper caste population in India should be only 6% which is quite ridiculous,” it stated.

Sub: National Highways Development Project (Golden Quadrilateral and North-South, East-West Corridors) — A dream project of unparalleled importance to the Nation but in reality a great loot of public money because of very poor implementation at every state.

Hon’ble Sir,

Through this letter, I wish to draw your kind attention towards great lapse in the implementation of above project. Since such letters from a common man are not usually treated with due seriousness, I wish to clarify at the outset that this letter is being written after careful thought by a very concerned citizen of the country who is also very closely linked with the project. I request you to kindly go through my brief particulars (attached on a separate sheet to ensure secrecy) before proceeding further.Instead of writing at length, I would be very specific and to the point highlighting the areas where there have been great lapses and would suggest certain remedies to the best of my abilities. I have been posted both at NHAI, HQ and at site on NH-2 Projects and therefore my direct experience is with NH-2 Projects (World Bank Funded). However, the story is almost same with all other projects which are under implementation and would be no different for forthcoming Projects unless we take certain corrective measures immediately. I have gone through most of the files (even closed ones) dealing with NH-2 projects (their design consultancy, procurement of civil contractors, selection of supervision consultants, the mobilisation of contractors and consultants, etc.). The areas of concern are highlighted below:

Preparation of detail project reports (DPRs) by the Design Consultants

The DPRs prepared by the design consultants are in very poor shape and cannot be implemented in the field without major modifications. It appears that the design consultants have made the designs and drawings with little consideration for the actual ground conditions and the same have been accepted by NHAI without any scrutiny. The proof consultants (deployed for checking DPRs submitted by Design Consultants) appear to have done only cosmetic work and it appears that the officers in NHAI have not even opened the final DPRs submitted by the consultants before putting the works to tender. The result is that the DPRs, on the basis of which tenders have been called, are like garbage. When the problems are being noticed in DPR at the implementation stage and the design consultants are being requested to clarify them, we are getting a very cool and negative response from them. This is contributing to delay in the implementation of projects.

A good DPR is one of the foremost requirements for the smooth implementation of the Project and we are faltering at the very initial stage. In the present system there appears to be no accountability on the part of Design Consultant. To ensure this, we should evolve a system whereby the design consultant can be made accountable for any problem in the implementation of DPR and their consequent implications in terms of time and cost overruns. A system of insurance may be devised to address this issue. The Design Consultant may be asked to keep his establishment at site in the initial stage of implementation of project, so that any design issue may be addressed speedily. Alternatively, we may link substantial portion of payment of Design consultants to the implementation of DPR in the field. Another way may be to award design consultancy (for preparation of DPR) and supervision consultancy (to supervise the execution of project) to the same consultancy firm so that any discrepancy noticed in DPR at the execution stage is corrected by the same firm. We may deliberate further to arrive at the most suitable option.

Procurement of civil contractors

The process of procurement appears to have been completely manipulated and hijacked by the big contractors. Many contractors are submitting forged documents to justify their technical and financial capabilities to execute the project. The big contractors have been able to get all sorts of help (including even the most secret information and documents) from the officials in NHAI and even the note sheets carrying approval of chairman have been leaked outside. (This mostly appears to have been done by lower officials and supporting staff). Little thought has been given to the ability & sincerity of some of the contractors to do the work they have quoted for. The three striking examples are awards of NH-2 to M/s Centrodorstoy of Russia, M/s China Coal of China and M/s LG of South Korea which are all working like commission agents by collaborating with local incompetent and inexperienced firms and trying to get the work done through them. M/s Progressive Constructions Ltd is another contractor which appears to have completely manipulated the system to get the award of 2 projects on NH-2. This company is not organised on professional lines and it is run like a family business. They get one work and assign it to one relative, the second is assigned to another and the story goes on.

There is an urgent need to have a fresh look at the whole procurement process and utmost care needs to be exercised at the time of selection of contractors. The whole process should be made more transparent and any official found colluding with the contractors should be severely punished.

Mobilisation of Contractors and Mobilisation Advance to them

NHAI officials have shown great hurry in giving mobilisation advance to the selected contractors (no surprise, as the commission to officials for award of work are linked to the contractors getting their first mobilisation advance). In some cases the contractors have been given mobilisation advance just a day after signing the Contract Agreement. The entire mobilisation advance of 10 per cent of contract value (which goes up to Rs 40 crores in certain cases) has been paid to the contractors within a few weeks of award of work but there has been little follow-up to ensure that they are actually mobilised at site with the same pace. The result is that the entire mobilisation advance remains lying with contractors (or get diverted in their other activities) for months — a way for contractors to make easy money and for client to loose interest charges on them. Most of the contractors have not mobilised even up to 50 per cent, a year after getting their mobilisation advances.

Similar diversion or idling of funds are taking place in case of equipment advances to the contractors, another 10 per cent of the contract value. In many cases, the equipment is not being purchased and, even if purchased, is being used somewhere else. The contractors are getting customs and excise duty exemptions on most of the road construction equipment. However, because of laxity on the part of NHAI, the contractors in many cases are buying equipment on behalf of or for other parties and appropriating a portion of the excise/custom duty exemptions in their pocket.

We need to be vigilant and careful in giving advances to the contractors. The advances are given to the contractors to mobilise them quickly in the interest of project and therefore the same should be linked to their actual mobilisation at site. The advances should be given in installments and the release of next installment should be made dependent on utilisation of the previous installment. A strict vigil and audit needs to be done to ensure that the advances are used by contractors for quick mobilisation and are utilised in the same project for which they are being given.

Selection of Supervision consultants and Design consultants

The concept of supervision consultancy is a step in very right direction and the amount spent on them (roughly 2-3% of the cost of civil works) is a good investment. But here again we are faltering at the implementation stage.

There is a big fraud in the selection of Supervision/Design consultants which mainly depends on their technical manpower. To get the consultancy work, the consultants are proposing to deploy well-qualified and senior professionals in their technical proposals (many times their qualification and experience are being forged and NHAI officials are not taking any pain to ask for the documentary proof in support of their claims).

Many a times, the same professional figures simultaneously in technical proposals forwarded by many consultants and NHAI officials are doing little to discourage it. However, once that work is awarded to them, they are invariably coming with the request for replacement of their proposed personnel with professionals of much less qualification & experience.

To our shame, we in NHAI are giving least resistance to this trend and the proposals for replacement of professionals are being approved freely. The curriculum vitae of professionals are invariably being fabricated and manipulated by consultants to get approval, as the NHAI officials are not asking for any documentary proof in support of the qualification & experience claimed. Instead they are abetting this crime.

The consultants in first instance come with the replacement CV to have an informal discussion with the officials. However, once they are given the feeling that the same can’t be approved on file, the CV of same man is properly fabricated (in connivance with NHAI officials) and submitted formally and the approval is granted. This is the state of affairs.

The end result is that the consultants propose to deploy the most qualified, experienced and senior men in their organisation (or outside their organisation) to get the work and, once awarded the work, replace them by much inferior persons. They propose the same senior team to get another work and repeat the same story of replacement and the drama goes on.

This way, the consultants are completely manipulating the system. The well-qualified persons in head offices of consultancy firms are thus being used simply to get the work, but they are not being sent to the site, where they are being proposed to be deployed. The field units of these consultancy firms are instead being asked by their Head offices to look for the required personnel. The result is that many key professional posts are lying vacant for months or are being filled by unqualified person. In all these, it is the project which ultimately suffers.

This whole drama can be very easily checked provided we have the will. It is all the more easy in the totally computerised system at NHAI. A few steps outlined below will go a long way in remedying this ill.

(i) No consultant should be allowed to propose the deployment of same professional in more than one technical proposal.
(ii) It should be ensured that the same person is not proposed to be deployed by more than one consultancy firm.
(iii) It should be ensured that the person proposed by a consultancy firm is actually working in the firm or is having a bond with the firm to work in the project if the firm is awarded the project.
(iv) Replacement should be approved only under very extraordinary circumstances and a penalty should be imposed on the firm for their inability to deploy the proposed professional.
(v) All documentary proof in support of the qualification & experience claimed by a person should be asked.

In summary, it should be ensured that the supervision consultants deploys a well qualified & experienced team for proper supervision of the work. This becomes all the more important, because the supervision consultant (known as Engineer in FIDIC contract document) has been given immense powers & responsibilities under FIDIC conditions of contract which we are following.

The problem of subletting or subcontracting

The NHAI is going for International Competitive Bidding to procure the most competent Civil Contractor for execution of its projects. The works are usually being awarded at high cost and the contractors are assuring the best quality in the execution of projects. However, when it comes to the actual execution of works, it is found that most of the works (sometimes even up to 100 per cent) are being sublet or subcontracted to small petty contractors who are not at all capable to execute such big projects and ensure the quality of construction assured by the Civil Contractors. As a result, the entire process of shortlisting & pre-qualification of contractors and International Competitive Bidding are being nullified and what we are getting are the numerous petty contractors working at site and making a mockery of the prestigious project. The main Civil Contractors who have been awarded the work by NHAI are doing all these under the veil of labour contract which is permissible under the Contract Agreement. But in reality, they are getting most of the work done through numerous small petty contractors (main contractors are supplying only a few critical equipment & materials) at 50-60 per cent of the price quoted by them and the rest 40 per cent of contract price is being pocketed by them without much effort. In the process, the main contractors are working just like commission agents.

I would like to mention here that the above phenomena of subletting and subcontracting is known to all from top to bottom but every one is maintaining a studied silence. It would not be inappropriate to say that all these mouths have been shut by these big contractors who are manipulating the system and individuals alike. These petty contractors are bringing poor equipment & material, giving a big setback to the progress & quality of work. The main contractors are least bothered about the timely completion of projects (and penalties, if they are unable to finish the work in time) as they are quite sure of getting time extension by manipulating the individuals. They have already started fabricating spurious claims to make grounds for time extension and cost overruns. If this issue of subcontracting is not taken up with urgency, the entire project will be a very big failure both in terms of quality of construction and timely completion.

This issue cannot be expected to be tackled by field units of NHAI as the decision to sublet the works are being taken by Head offices of the contractors & not their field units. To address this, the top administration in NHAI has to take up the matter aggressively with the top management of contractors.

NHAI organisation & office system

It would not be inappropriate to say that there is no system in NHAI, there are only individuals. There is an urgent need to review and restructure the office procedure and office set up including the file system. Record keeping is very poor and it would be difficult to trace even the most important papers after some time.

The entire organisation is almost based on sourcing people on deputation basis. There is a need to have some permanent cadre strength in NHAI. In its zeal to maintain a lean and thin organisation, one Accounts officer/Manager (Finance) is allotted to two Project Implementation Units spaced around 200-300 kms apart, which is a mere nonsense. There is an immediate need to deploy one Accounts Officer/Manager (Finance) in each PIU, which have to manage projects of around Rs.1,000 crores.

The earlier we take up these issues, the better it is for the health of NHAI. If some well-planned measures are not taken soon, the NHAI as a system is headed for big failure.

As a concerned citizen of the country, I have brought these issues to your notice for your kind intervention and necessary action. Looking at the enormity of public fund involved in the project, the matter needs your urgent attention.

I have written all these in my individual capacity. However, I will keep on addressing these issues in my official capacity in the limited domain within the powers delegated to me. If any elaboration/clarification is needed on above issues I would be glad to render all my assistance in the interest of this very prestigious National Highways Development Project, which is undoubtedly the biggest ever project undertaken in India after independence.

Thank you for exposing the misconduct of SKDF from very first few days of it’s founding.

 

Scores of anti corruption activists and whistle blowers for the first time in the history of India, joined under SKDF but SKDF eased them out one by one.

 

Since Aman, Bansal and KP were just infants in this field, we were repeatedly “Advising, Challenging and Questioning” SKDF conduct and operations. They didn’t like our ideas to investigate very serious cases of public loot. SKDF PIL was a deliberate mischief is given out by the question asked by Supreme Court judges -“Why we should entertain a duplicate PIL?” which was filed after 100 days.

 

SKDF never exposed the Whistleblower Satyendra Kumar Dubey’s charge sheet.

 

Within a month or two months SKDF had Rs.3 million paid by checks alone but didn’t support any other case of “Public Loot And Cheating”. There is no accounting of donations thereafter though accounts were operational and SKDF solicit donations even now.

 

Instinctively we knew SKDF was meant to drain away our energies and time until elections are over and was a secret “Operation Cover Up To Save Shining Campaign”. I used to tell the three that we individually are operating since the three snakes were not even molecule on earth.

 

SKDF didn’t care about live whistleblowers and turned it in to business the sacrifice of Martyr S.K. Dubey and silenced his last wish.

 

Whistleblowers demand investigations in to the mismanagement of SKDF funds and Bungling in PIL by CBI.

I would like to remind you that I have been posting Reliance related messages and my comments regularly for more than three years. I am a member of many forums and SKDF was one of the first platforms that posted my messages. You were just a member at that time. For some reasons (best known to the then SKDF decision makers), my messages were rejected by the moderators. I tried to reason with the moderators and when they stuck to their stand, I stopped posting my messages to SKDF and moved over to other Groups.

 

You have, in your current message to Shri. Ravinder Singhji, made some

improper remarks about Reliance related messages posted to SKDF. I

suggest that you refrain from making such baseless remarks. Over the past three years, I have been able to provide all the readers with more than adequate evidence of my contentions that Reliance Group (read as Ambanis) are out to subjugate our country. You are more than aware of this fact.

 

I am not interested in spending time over evaluating the performance of SKDF and I suggest that you stop dropping pearls of your wisdom about the Reliance issue.

Friends,

These are the comments of CEO of SKDF, a publicly funded organization to fight corruption and support whistleblowers. You can see through the casualness and irresponsible conduct of Kalyan Panda who have collected millions in the name of fighting corruption and to support whistleblowers. It was only a small paragraph but says it all. So I separated each sentence to fill the page.

 

KD and I were senior most and very seriously active on the group, also active were Sucheta Dalal, YP Singh and V.B. Singh but as you can read we were allowed only one or two messages in seven days week.

 

Our messages are said to be “boring”.

 

Exclude our messages and SKDF was a Non Sense Club. By way of example: There will be say 10 messages on “Relay Fasting” in a day.

 

“I went on fast (after taking heavy breakfast) from 8AM to 5PM today, my pregnant wife also joined me”, there will score of messages “How is your wife—?” Tour of SKDF group from early days will reveal everything.

Do not be over enthisiastic.

 

I felt you are getting somewhat negetive response which may not be correct for your mission. In this msg also your subject matter is different.

 

It is not only me but many people had/has objected and very few people has supported (statistics). You might remember Rambo's comments also in Jago-india.

 

You may refute but the facts would remain that you should not bore people(the problems with e-groups).

 

If I ask what is the result in 3 years you may not feel comfortable.

  • In Delhi alone over 50,000 phones were “Tapped On Record” many-many times more illegally.
  • BSNL continues to be the backbone of telecom in India.
  • BSNL/ MTNL continues to provide cheapest and affordable service.
  • Line quality of MTNL or BSNL in cities is far superior to other landline services.
  • People could attach even 5 extensions and would be able hear the voice but in case of Touchtel or other competitors.
  • Reliance and other private operators have grossly violated terms of license to operate services in rural areas and would have been liable to face cancellation of their licenses.
  • Reliance and other competitors have engaged “Thugs &  Goondas” that first send inflated bills and followed by goonda action and abuses. This has never happened in MTNL / BSNL regime.

Dear Madam,

There is a great security risk in allowing a Private Company to control a vital sector like communication. The primary objective of such a company is maximizing profits and this objective might be in conflict with the interest of the public. The Company can control all voice and data communication in India within no time and hence might pose a serious threat to the fundamental rights of the citizens of our beloved country.

Everything that is said on the company’s network, it could hear. Everything that is written on the company’s network, it could read. All the communication on the company’s network could be stored and retrieved at the company’s directions and will. All this can happen without the knowledge of the company’s customers.

The company could zero in on anyone and everyone that they choose (for whatever reasons and this fact has to be understood on the background of the current situation where a judicial order is required to tap a single telephone line). The company’s poor customers might not even know what hit them (they might not even know that something hit them) and they might continue to attribute missed opportunities as mere bad luck or stroke of fate. The power of search engines on the internet is such that if the Company so decides, it can virtually monitor & filter the entire traffic on its network.

Given an opportunity, I can explain all this in great details. Please spare your valuable time to consider this issue as it is linked with the very freedom of all the people of our country. Awaiting an early reply.

NEW DELHI, DECEMBER 5: Don't tell this to Satyendra Dubey’s family. One full year before he blew the whistle on the Prime Minister’s showpiece project and two full years before he was killed, there was a Whistle Blower Act for India on paper. That paper gathers dust but what is even more telling—and a stark coincidence—is the genesis of this proposal. For, nothing could be more appropriate a match for Dubey’s case as this.

The Law Commission of India, right on the first page of its 121-page report calling for the Whistle Blower Act, justifies it by referring to a speech by Prime Minister A B Vajpayee himself.Commission chairman and former Supreme Court judge Justice B P Jeevan Reddy invokes the speech ‘‘condemning rampant corruption and highlighting the principle of ‘zero tolerance’ not only from the demand side of public servants but also from the supply side.’’ In other words, he was referring to zero tolerance for bribe-givers and bribe-takers.

Evidently, Dubey shared the Prime Minister’s conviction: he had zero tolerance from the ‘‘demand side’’. And it was to expose the ‘‘supply side’’ that Dubey wrote the letter to the Prime Minister.

Justice Reddy says that Vajpayee’s speech has been referred to him by the then Central Vigilance Commissioner N Vittal. Vittal had asked the Law Commission to draft a Bill ‘‘encouraging public servants to disclose corrupt practices on the part of public functionaries.’’ The reason Vittal gave for seeking a law protecting whistle blowers is starkly similar to the reason Dubey gave for disclosing his identity in the letter to the PMO and then requesting it to be kept confidential. In his letter to the Law Commission, Vittal said he had ‘‘banned actions on anonymous/pseudonymous complaints which had been lodged by disgruntled elements to blackmail honest officials resulting in their demoralisation.’’ As a corollary to this, Vittal told the Law Commission that he had set up a system in the CVC in which an honest public servant sending a complaint of corruption or maladministration would be assured of his identity being kept confidential. But, since such an arrangement does not exist in the Government, Dubey’s identity was leaked out despite his request to keep it confidential.

       So everybody is on the same page....
The foundation (Non-Profit) Articles of Incorporation and 
other legal papers are being filed with the Department of State, FL for "The SK Dubey Foundation, Inc.". 
The Foundation effective date will be Monday December 8, 2003. 
Monday/tuesday I will set up the Bank accounts and complete other legal formalities. 
I will post the Foundation's certificate of Good Status next week upon reply from Department of State.  
We should talk to prominent names to invite them to join our Board. the Board members should be identified shortly. 
the Books will be transparently kept so everybody will be able to see where the money is being obtained from and is going.

every upright government officer.  I had enclosed my identity on a separate sheet so as to ensure secrecy and at the same time make any further contribution
 if asked upon to do so. It is however regretted to inform you that, due care has not been taken to maintain the secrecy of my identity and even the separate sheet 
containing my identity has been forwarded to the concerned authorities. As a result, my identity has been leaked.

PATNA: If you were outraged by the fact that the government did not honour Satyendra 
Kumar Dubey's request for secrecy, read on. 
The National Highway Authority of India project director who was shot dead had written to his 
boss saying that his letter to thePMO had been leaked and he was exposed to
 ``undesirable pressure and threat.''

Though Dubey never complained to the police or suggested to his family

about any threat to his life, the letter to the NHAI chairman shows he was

threatened. Dubey, an IIT Kanpur graduate, was shot dead on November 27

and this website's newspaper on November 30 reported that he had

highlighted corruption in the Golden Quadrilateral in a confidential letter

to the PMO and the letter had been leaked.

The letter to the NHAI chairman is marked ``confidential'' but undated.

However, it was sent this year as it refers to communication dated

February 2003.

Instead of following up on his complaint, the central vigilance officer (CVO)

of the NHAI ``reprimanded'' Dubey for writing directly to the PM,

confirm sources.

 

The CVO reportedly wrote to Dubey that he was not supposed to

correspond to the Prime Minister regarding corruption.

The Gaya police are in possession of these documents and are looking

for more. The officer who reprimanded Dubey has gone to his parent cadre,

UP. In fact, in the letter to the NHAI chairman, Dubey too refers to a letter

from the vigilance division of the authority.

When contacted, N C Dhondiya, DIG, Magadh Range, who is heading the

investigation, said the police have seized a number of letters and

documents but he could not disclose anything at this stage as this

might hamper the investigation.

I wouldn't touch Tehelka with a 10 foot poll -- this campaign will lose all credibility.  Reason -- 
Tehelka was ultimately a "setup" -- a corruption scenario was created using fictitious entities for media value.  
This is the exact opposite -- a *real* incident happen, a *real* person got killed -- you can't dismiss this lightly. 
What we want is persistent even-handed enquiry to get at the truth in this matter, and find whoever is guilty, 
not fly-by-night sensationalism.

At the outset, I would like to make a correction. I had posted my messages on May 23, 2004 (and not May 22, 2004). 
I have realised it on my own and admit the mistake (in spite of the fact that it does not change anything).  
I have not made an accusation. I have stated the truth. I am sure you realise the difference. 
There is every opportunity for Atal to prove me wrong. Why is he not doing it it? 
Since you happen to know Atal, please write to him and ask him to settle this issue.  
Please understand the goals of the foundation. Fighting against corruption is not a frivolous thing. 
Atal Bansal has time to lie and mislead the group and yet he is a very busy man.  
Shifting to the forum was a mistake. I was against it all along ( so were some other members) 
and the fact that there was scant response more than proves my stand. 
The fact that discussions resumed once the Group was back to the message board further proves my stand. 
I would not have mentioned this on my own, 
but you did not leave me any choice. Now if I say that it reflects on the decision making ability of the people who made that decision, 
I will be branded as a trouble maker. 
 Try and think about it. I do not want to rub it in. Please back off with grace.

Did I not request everyone to move to Forum page so that for once and for all we can stop playing this blame game. 
You will be able to post to your heart's content and it will not be suppressed. 
As it is, it is being difficult to moderate messages, and on top of that, these accusations.  
I don't think any one of us has bad intention, 
its just how it is being interpret across the wires. I don't know many of you personally but I know Atal. 
He is very passionate about the foundation and in achieving its goals, otherwise 
he would not have started it in the first place. 
We are hardly finding time to contribute and sustain this fight and it won't make sense to loose those times 
on such frivolous things.  
Please understand the goals of the foundation and lets come up with an action plan to achieve them.

Too bad that they are emphasizing the differences rather than the meeting points.  
Btw, I dont know how to go to the forum page and so I have not been getting/reading any posts

I was told that there will be links/posts to lead people, and I had expressed fear that moving 
to the forum would be a 
good way to dissolve the dialogue/joining of more people.
